Terms & Conditions
The terms that apply when you browse this website, use its content or submit a project enquiry.
Last updated: 1 September 2026
1. About these terms
These terms govern use of pixolite.com. By using the website, you agree to these terms. If you do not agree, please stop using the website.
Pixolite is an independent software studio based in Northern Ireland and operated by Damian O’Hagan. You can contact Pixolite at hello@pixolite.com.
2. Website information is not a project contract
The website describes services and provides general information. It is not professional legal, financial or regulatory advice, and it does not by itself create a client, partnership, employment or other contractual relationship.
Submitting an enquiry is an invitation to discuss a possible project, not an acceptance of work or a guarantee of availability. Paid work will be governed by a separate written proposal, statement of work or service agreement covering scope, price, payment, ownership, delivery, support and termination. If those project terms conflict with these website terms, the project terms take priority for that engagement.
3. Permitted use
You may use this website lawfully for personal or business information purposes. You must not:
- use it in a way that breaches applicable law or another person’s rights;
- attempt to gain unauthorised access to the website, accounts, systems or data;
- introduce malware, carry out denial-of-service activity or interfere with operation;
- scrape, copy or extract substantial content for commercial reuse without permission;
- misrepresent your identity or submit unlawful, defamatory or misleading material; or
- use the enquiry form for spam, automated promotion or abusive communications.
Access may be restricted or blocked where reasonably necessary to protect the service.
4. Intellectual property
Unless stated otherwise, Pixolite owns or licenses the website’s design, branding, software, text, graphics and other content. All rights are reserved.
You may view pages, share ordinary links and make a reasonable copy for your own internal, non-commercial reference. You may not reproduce, republish, sell, modify or commercially exploit website content without prior written permission. Client names, marks and project material remain the property of their respective owners.
5. Accuracy and availability
We aim to keep the website accurate, secure and available, but content may become outdated and uninterrupted access cannot be guaranteed. We may update, suspend or withdraw any part of the website without notice where reasonably necessary.
Illustrations, interface examples, indicative statistics and descriptions may be simplified demonstrations unless expressly identified as measured client results. You should verify information that is important to a commercial decision with us directly.
6. Third-party websites and services
Links to third-party websites are provided for convenience and context. Pixolite does not control those websites and does not endorse or accept responsibility for their content, availability, security or privacy practices. Third-party terms apply when you use them.
7. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing affects any mandatory rights you may have as a consumer.
To the fullest extent permitted by law, Pixolite is not liable for loss arising solely from reliance on general website content, inability to access the website, third-party links, or unauthorised interference outside our reasonable control. For business users, Pixolite is not liable through use of this website for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or data. Liability connected with paid services is governed by the applicable project agreement.
8. Privacy and cookies
Personal information and cookies are handled as described in the Privacy Policy. Optional analytics is disabled until you consent and can be changed later through Cookie settings in the footer.
9. Governing law and disputes
These website terms are governed by the laws of Northern Ireland. The courts of Northern Ireland will have jurisdiction over disputes relating to these terms, except that a consumer may retain any mandatory right to bring proceedings in another part of the United Kingdom where applicable.
Please contact hello@pixolite.com first so we can try to resolve any concern promptly.
10. General
If any provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver of that right. No person other than you and Pixolite has a right to enforce these website terms under the Contracts (Rights of Third Parties) Act 1999.
We may revise these terms to reflect changes to the website, services or law. Updated terms apply from publication, and the date above will be changed.
